The “Work Outside, Vote Inside” Rule

A common compliance error is assuming the holiday is based on office location. It is not. It is based on the employee’s voting registration.

Example: An employee works at your factory in Taloja (Industrial Area) but resides and votes in Panvel Municipal Corporation. Since Panvel is going to polls, you MUST grant that employee a paid holiday, even though Taloja might be working normally.

Strict Conditions for “2-Hour Concession”

The government circular explicitly states that a concession (2-3 hours off) is an exception, not a right of the employer.

  • Allowed Only For: Continuous process industries or emergency services where full closure causes danger or massive loss.
  • Risk Factor: If you grant only 2 hours and the employee fails to vote due to traffic or distance, the employer is liable for legal action.
